SHIVER to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., acting solely as nominee for H&R BLOCK MORTGAGE CORPORATION, dated September 18, 2006, recorded September 29, 2006, in Deed Book 00950, Pages 0210-0226, Madison County, Georgia Records, said Security Deed having been given to secure a Note of even date in the original principal amount of ONE HUNDRED SIXTY-EIGHT THOUSAND THREE HUNDRED AND 00/100 DOLLARS ($168,300.00), with interest thereon as provided for therein, said Security Deed having been last sold, assigned and transferred to Bank Of America, NA, Successor By Merger To Countrywide Bank, FSB, there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Madison County, Georgia, within the legal hours of sale on the first Tuesday in July, 2009, all property described in said Security Deed including but not limited to the following described property:
All that tract or parcel of land, with improvements thereon, lying and being in the 591st G.M. District, of Madison county, Georgia, designated as Tract 2 containing 9.583 acres, and being bounded now or formerly as follows: on the east by right-of-way of GA. Hwy. 281; on the southeast by Tract 3; on the southwest by lands formerly owned by Shipp; and on the northwest by Tract 1.
Said lands being more particularly described as Tract 2 in a plat of survey for D.G. Burkhard dated March 24, 1978, prepared by Ben McLeroy, Registered Land Surveyor, recorded in Plat Book 15, Page 237, Madison County Public Records. Said plat and the recordation thereof are by reference incorporated herein and made a part of this legal description.
