Man charged with pedestrian under the influence
A Comer man was arrested recently after a deputy found him lying in the middle of Hwy. 72.
Spencer Levar Howard, 31, 2346 Sims Kidd Road, was charged with one count of pedestrian under the influence.
According to the sheriff’s office, Deputy Alan Stratton responded to the report of someone lying in the road, with callers stating that he appeared to have been hit.
When Deputy Stratton arrived he observed a black male lying in the road on his back with arms outstretched. When he called to the subject (Howard) he received no response so he attempted to locate a pulse. At that time Howard became responsive and when Stratton asked him how he was Howard reportedly leaned up and said he was fine and that he drank too much. Howard was assisted out of the road, arrested, and taken to the Madison County Jail.
In another arrest, Manuel Ricardo Nunez, 38, of 160 Mill Street, Royston, was charged with obstruction of an officer after deputies found him hiding in his girlfriend’s attic.
According to the incident report, a woman on Hwy. 98 East called to report that her boyfriend, Nunez, for whom she had taken a restraining order against last year, was at her residence and she wanted him removed.
Deputies located him in the attic and transported him to jail.

That's like the age old Question. If a tree falls in the forest and nobody is around does it still make a sound? Someone ask the DA why not charge him with DUI too?
Or the DA could charge him with a citizen lying under the influence. Because he is a citizen and he was under the influence and his was lying?
