I had an interesting experience recently with the Madison County Board of Commissioners and Zoning Administrator Linda Fortson about county zoning. It regarded a Comer property owner who installed a second dwelling without a permit on her agricultural land at Map 68 Parcel 29B off Hwy. 98 in District 4. This act pushed the limits of the zoning ordinance because only four dwellings are allowed on a private road. Her second dwelling disadvantaged one of the abutters, who now must pay a fee to apply for a variance. However, District 1 Commissioner Stanley Thomas, District 2 Commissioner John Pethel, Sr., District 3 Commissioner Mike Youngblood voted for the property owner anyway, deeming that the first dwelling is a dwelling but the second one is not a dwelling because it is a caretaker’s cottage. So it doesn’t count toward the four-dwelling rule. Good to know.

JORDAN to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., recorded in Deed Book 444, Page 127, Madison County, Georgia Deed Records, and securing a Note in the original principal amount of $95,000.00, Mortgage Electronic Registration Systems, Inc., the current holder thereof, has declared the entire amount of said indebtedness evidenced by the Note immediately due and payable and, pursuant to the power of sale contained in said Security Deed, will, on the first Tuesday in September, 2008, to-wit: September 2, 2008, during the legal hours of sale, before the Madison County Courthouse door, sell at public outcry to the highest bidder for cash, the following described real property:
All that tract or parcel of land, together with all improvements thereon, situate, lying and being in the 382nd District, G.M., Madison County, Georgia, and being known and designated as Lot 3, Pine Ridge Subdivision, and being more particularly shown on a survey entitled “Survey for Pine Ridge Subdivision”, dated December 19, 2001, by James M. Paul, Registered Land Surveyor, and recorded in Plat Book B-75, Page 8, in the Office of the Clerk of the Superior Court of Madison County, Georgia, reference to which is hereby made for a more particular description of the property herein conveyed.
The aforedescribed real property is also known as 2345 Shoal Creek Road, Colbert, Georgia, according to the present system of numbering houses in Madison County, Georgia.
This sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit as to the amount and status of the loan with the holder of the Security Deed, including but not limited to, a determination that the borrower has not reinstated the loan prior to the foreclosure sale.
Said real property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the real property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
Upon information and belief, said real property is presently in the possession or control of SOCORY J. JORDAN and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney’s fees, all as provided in said Security Deed and the excess proceeds, if any, will be distributed as provided by law.
