Inmate charged after allegedly attacking officer with ‘spork’
An inmate at the Madison County Jail was charged with aggravated assault recently after he reportedly tried to attack an officer with a “spork.”
According to the report, Jimmy W. Rutherford, 32, tried to stab the officer in the booking area of the jail. The officer pulled his taser weapon and ordered him to stop. Rutherford then allegedly raised his arms and yelled “I’m through.” He then returned to his bed and sat down.
Rutherford told another officer he kept knocking on the door because he needed to urinate and couldn’t because there was no toilet paper in his cell. A roll was located in his cell. Rutherford then said he had just wanted to give the spork to the officer so he wouldn’t get in trouble for having it. The officer noted that the spork had been filed down on the handle end of it to a sharp point.
In another incident, Lloyd Smith, 39, homeless, was charged with simple battery FVA and simple battery after he allegedly attacked a woman on Oak Circle by punching her and throwing her to the floor several times. He also reportedly poked his finger in the face of another woman at the residence. According to the incident report, Smith was found in the bedroom of the residence hiding under a blanket.
Other incidents on file at the sheriff’s office this week included:
•Three landscape trucks reportedly stolen from Oglethorpe County were recovered Tuesday after they were abandoned on Nowhere Road. Lawn mowers and other equipment had been taken from the trucks, according to the sheriff’s office.
•Two juvenile females were taken to the sheriff’s office and released to their parents after the principal reportedly saw them fighting in the high school cafeteria.
•A man on King Street reported that someone broke all the lights out of the light fixtures in a building there.
•A woman on Glenn Carrie Road reported that someone paying her cash for a pick up she sold them gave her a counterfeit $100 bill.
•A man on S&M Road reported that his ex-wife refused to leave his residence. He said he told her she could stay because she had nowhere else to go but that she had started arguing so he asked her to go. The woman was inside packing her things and said that her ex-husband had slapped her in front of her children, who were asleep on the couch.
•A handgun was stolen from a vehicle on Candlestick Drive.
•A storage shed at the county farm was burglarized.
•A green car was stolen from a home on Homestead Road. The owner advised that the keys might have been in the vehicle.
•A mailbox and post were stolen from a home on Colbert-Danielsville Road.
•A vehicle was burglarized on Garnett Ward Road.
•Theft by taking was reported on Daniel Road when a woman reported numerous items taken from her farm. They included a Ford truck, an RTV, a zero turn mower, a trailer, a black feed bin and an air compressor. The woman said she heard her dogs barking around 1:30 to 2:30 a.m. in the morning but did not think anything of it.
•An old truck used for hunting was reportedly stolen from a horse pasture on John Pruitt Road. The gate was broken into resulting in the horses also getting out.
•A woman reported that her home on Manley Martin Road was broken into. A window a/c unit was found on the floor of the master bedroom with broken glass and a gun cabinet in a bedroom had also been rummaged through, but nothing was reported missing.
•A 32–inch flat panel TV was stolen from a home on Jones Matthews Road.
•Burglary and criminal damage to property were reported on Forest Lane Lane.
•A man on Hardman Morris Road reported that someone had taken two weed eaters and a chainsaw off his back porch sometime during the night.
•A woman on Scogin Road reported that she and her husband had gotten into a verbal and physical altercation and that he had struck her in the face several times using his hands and his shirt. She said she had gotten hold of a gun and told him to get off of her, but that she did not point the gun at him. The offender also said she did not point the gun at him and that she had given the gun to a neighbor. They said they were arguing about the offender’s mother, who lives at the residence, but was not present at the time. The offender agreed to leave the residence and the woman said her sister was coming to pick her up also. She was advised of the warrant process should she decide to pursue charges.
•Warrants have been issued for a husband and father after he allegedly assaulted his wife and her son at their home on Diamond Hill Colbert Road. The officer reported that the house was in disarray and that there was a broken picture frame lying on the floor along with a broken piece of glass from the coffee table and a fan lying on the kitchen floor. The woman said she was in her room when she heard her husband yelling at her son. When she came into the living room she saw him straddling her son as he lay on the couch and choking him. When she tried to intervene, her husband reportedly slapped her and her son. Her husband then grabbed a partially disassembled shotgun and held it like a bat as he threatened the son with it. Her son then kicked the man, knocking him onto the coffee table, causing the glass to break and cutting the man, who had left prior to the officer’s arrival. A lookout was posted for the man’s vehicle in surrounding counties and warrants were to be issued for his arrest.
•Statutory rape was reported on Hickory Hills Road between a 23-year old man and a 15-year old girl.
•A home was burglarized on Spratlin Mill Road. Nothing was missing from the home and it seemed the burglar(s) had been looking for something particular. Firearms, electronics and other valuables were left untouched.
•A Dell computer was stolen from a pickup truck on Candlestick Drive.
•A gun was reportedly taken from a truck parked on Hillwood Drive.
•A man on Hwy 29 South reported that someone had taken approximately 300 pounds of aluminum cans from behind his barn.
•A man and woman on McCarty Dodd Road reported that the man’s ex-girlfriend had been calling them and making threats. The ex had gone to the house that day and was allegedly threatening to burn down the trailer. She also offered to drive her car through the trailer and spray the man with mace. They were advised of the temporary protective order (TPO) process.
•A woman on Paoli Road who has a TPO against her husband reported that he had been riding by her house several times that day. Her son said he was in Tiny Town grocery when the man came into the store and began to argue with him. He also said the man had a gun in his truck. The woman was advised of the warrant process.
•Someone reportedly drove off without paying for $36 worth of gas at Paoli Junction.
•A man on AC Carey Road reported that someone took a five-gallon gas can with kerosene in it from his yard.
•A woman traveling on Hwy 172 advised that her Ford Focus had been struck by corn that was coming off a Mack truck she was stuck behind. The truck was hauling a load of corn to Columbia Feed Mill and the driver said he was unaware corn was coming off his truck. The vehicle sustained minor damage.
•Copper wiring was stolen from a house under construction in Jacob’s Field (Candlestick Drive). Extra patrol was scheduled through the area.
•A home was broken into and ransacked on Friendship Church Road.
•A man on Stone Stewart Road reported that someone had stolen his wife’s flowers from the deck and yard.
•A man on Madison Avenue reported that his son kicked his scooter and threw his tools across the yard after they got into a fight over a job they had done. He also said his son tried to choke him.
•Simple battery was reported on Bedford Drive after a woman there said her live-in boyfriend had kicked her several times in the leg. She said she was afraid of him and wanted to go back to her home state. The officer contacted Project Safe and a worker from there picked her up to assist her in getting back to Ohio, where she and her boyfriend had just moved from.
•A central heating and air conditioning unit was stolen from a home on Crabapple Hollow Road.
