Victim holds burglary suspect at gunpoint
A burglary suspect was arrested recently after a Paoli Road property owner held him at gunpoint until officers arrived.
Mark Steve McGarity, 44, 320 College Avenue, of Elberton, was charged with burglary, possession of a Schedule II controlled substance, possession and use of drug-related objects and possession of tools for the commission of a crime.
According to the incident report, officers responded to a Paoli Road residence after the property owner called 911 to say he had a suspected burglar at gunpoint, with another suspect having fled on foot into the woods.
The property owner told officers he got a phone call from someone who said she had seen a car parked on his property beside the vacant residence with its hatch open. He came to the scene and found a Ford Explorer with its back door open, but no one around. He yelled and then fired a warning shot in the air, but still did not see anyone. He then left the scene to get his cell phone and flashlight, but not before he took the keys and wrote down the tag number just in case the suspect(s) tried to leave. When he came back, he found two white males in the Explorer attempting to leave. He held McGarity (the driver) at gunpoint while he called 911, but the passenger started walking towards the road, and began to run when he yelled at him and fired another warning shot in the air.
McGarity told the responding officers he had run out of gas and pulled in the driveway, and that he did not know the name of his passenger because he had just picked him up walking down the road. McGarity was wearing all camouflage, “as if he was trying to hide in the woods for some reason,” officer Bradley Free noted. The other suspect was said to be wearing a camouflage coat and blue jeans.
Free found a small silver can with a screw-top attached to the Explorer’s keyring and inside it were two plastic corner bags, one containing suspected methamphetamine. McGarity denied it was his, saying someone must have put the drugs in the container. Officer Free noted that McGarity appeared “fidgety” and that his eyes were glassy and he was very unsteady on his feet. During a search of the vehicle, an eyeglass case was found in the driver’s side door containing several syringes and a silver spoon, “both commonly used to ingest methamphetamine,” Free noted in his report.
Also located in the vehicle were numerous pliers and klines used to pull wiring, along with several types of copper wiring. There were also several knives and a baton located in the vehicle. Shoeprint evidence was taken from inside a vacant chicken house behind the house.
In another arrest, an Athens man was taken into custody last week after an officer was summoned to Athens Regional Medical Center to meet with a mother and child concerning child molestation.
The suspect, Janel Perez, 30, 540 Oglethorpe Avenue, Apt. 406, was subsequently charged with one count of aggravated child molestation. Harmony House in Royston was utilized for a sexual assault exam and a forensic interview, according to the report. No other information was available.
Other arrests on file at the sheriff’s office recently included:
•James Lewis McDougal, 226 White Oak Trail, Carlton, was arrested on one count of pedestrian under the influence of alcohol or drugs after he was found walking in the middle of the road with no shirt on. A 911 call had come from his residence earlier and McDougal, who was intoxicated, told officers he “drank too much and was tired of his girlfriend,” so he called 911. He said they had gotten into an argument and he wanted to leave, so he called the police. His girlfriend corroborated his story, saying he drank too much alcohol and then got belligerent with her, accusing her of cheating on him. As they argued, she said he grabbed her shirt and pushed her through a piece of lattice and into a vehicle. At that point, he called 911 and began walking away from the residence. The officer noted there were no marks on the woman, the lattice, or any vehicles.
•Joseph Justin Russell Williams, 27, 5657 Hwy. 29 South, Lot 19, Hull, was charged with one count of disorderly conduct after officers were summoned to Diamond Hill Mobile Home Park. Williams’ girlfriend told officers that Williams, who appeared to be intoxicated, became irate when one of her ex-boyfriend’s called her on the phone. She said that he began to scream and curse at her in the presence of her three children and that she asked him to leave, but that he refused. Williams allegedly raised his voice and cursed while the officers were there, despite being told repeatedly to be quiet.
•Noe Canas Albarran, 29, 41 Adams Street, Apt. 2, Lavonia, was charged with driving without a license, brake light/turn signal violation, possession of methamphetamine with intent to distribute and possession of cocaine with intent to distribute after he was pulled over by an officer for non-working taillights. Albarran was found to be unlicensed and the illegal substances were found during an inventory of the vehicle prior to its being towed.
•Jennings Thomas Limehouse, 46, 2326 Holman Autry Road, Danielsville, was charged with possession of tools for the commission of a crime, possession of a Schedule I controlled substance and crossing state/county guard lines with weapons, intoxicants, drugs without consent after a vehicle he was a passenger in was pulled over for driving recklessly. A blue eyeglass case was found under the passenger seat containing a clear glass smoking pipe. When asked if he had anything illegal on his person he replied “no,” but when he was being booked a plastic wrapper with methamphetamine crystals was found under his clothing.
•John Mark George Bessada, 38, 960 Garnett Ward Road, Hull, obstruction.
•Marcus Wade Cleghorne, 37, 147 George Washington Avenue, Colbert, weaving over roadway, more than two headlights prohibited and driving while license withdrawn.
