In the course of this, a charge was made that the property owner had built illegal apartments on another parcel she owned in the residential zone. The allegation was that three apartments existed on one five-acre parcel and another two in a barn. Mrs. Fortson then inspected the property.
I became curious as to what constituted an apartment so I read the county zoning definitions. “Article III: Definition of terms: APARTMENT: A suite of two (2) or more rooms and a bath which is designed according to the Southern Building Code and designed or intended for occupancy by one (1) family or one (1) person doing its cooking therein. For zoning purposes, an apartment is regarded as a dwelling unit. A structure containing two (2) apartments is a duplex.” The aforementioned apartments contained all these items, and some even had renters.
I had seen three of the apartments myself, and according to the definition, it seemed clear to me that the alleged illegal apartments would be deemed violations. But they are not! Why? Because: what is written down in the ordinance are not the real rules. The real rules are inside Linda Fortson’s head.
At the zoning office I asked Mrs. Fortson for her inspection results. She said that there were really no big problems. The apartment over the garage has a suite of two or more rooms, a bathroom, a kitchen for cooking and is designed for occupancy for one or more. But it wasn’t an apartment, she said. “It’s an art studio.” Good to know.
Despite having baths and kitchens and bedrooms and occupant, the two apartments in the barn were OK, too, she said. “There are a lot of barns in Madison County that have kitchens in them. It’s a break room,” Mrs. Fortson said. I was so happy to be learning the real definitions. To think, according to the zoning ordinance I thought a duplex had been created!
The apartment adjacent to the house had a suite of two or more rooms, and a bathroom and a kitchen for cooking, and had had renters, but amazingly this was not an apartment either. “It has a door that goes into the house. You could open the interior door from the living room and walk right in. The house came that way,” said Mrs. Fortson. What about the renters living there? I asked.
“They’re houseguests,” Mrs. Fortson said.
I was thrilled to learn how, I, too, can now earn extra income, by building two apartments inside my barn, over my garage, and inside my home. Even after inspection, Mrs. Fortson will allow it, because she knows the real rules.
Sincerely,
Elizabeth Prata

I was just curious is it possible you have way to much time on your hands?
Do you need a hobby, have you ever thought about just minding your own business?
I say Live and let live, keep your NOSE in your own world, and stop looking at your neighbors, unless what they do affects you.
Let the people we elect, the employees they hire do there job and SHUT your PIE HOLE unless your sticking pie in it.
Stay OFF other peoples land!
Stop your Gossiping!
You too can now earn extra income, by building two apartments inside your barn, over your garage, and inside your home, if you have the Money, Mrs. Fortson will allow it, because SHE knows the rules.
Sincerely,
A Good Neighbor
Have a nice day.
When my tax-paid government officials skirt the rules to support their own agenda at the expense of the county zoning, I speak up. Why? My government IS my business. It is yours, too.
Commissioners say they want to keep things rural but they go around the rules to make it comfy for thier friends. Good Ole Boys is right, Jim. T
Thank you so much for offering the bible to me. Sharing the Holy Word in Jesus’ name with a sincere heart is the most wonderful thing one person can do with another. Also thank you for your concern about my church attendance. I do attend Meadow Baptist each week and it is there I further my Christian education and enjoy fellowship with my neighbors. You are invited any time!
I also thank you for your concern about the unfortunate tenants who unknowingly end up living in illegal apartments, like me. Actually, it was the Christian ethic that would not let me stay there. I rented the apartment in good faith, but it was not rented to me in good faith. Reaping a benefit from an illegality will not do
When I was speaking with Ms Fortson about it, at the moment it became apparent I was indeed living in an illegal apartment, my face must have fallen. Ms. Fortson said, “I won’t put you out.” I thought that showed compassion on her part. The Zoning officials determine violations and if there are any, subsequent citations against the landowners, not the tenants. It seems from my case the tenants are not disadvantaged. It was my choice to move.
There is nothing wrong with living in a barn, I am sorry I gave you that impression, There IS something wrong with living in a barn when it has been made into an illegal duplex, according to the definition in our county here in Georgia. Things may be different where you live.
I believe it was Mary and Joseph who were denied a place at the inn.
PS- The last time I checked we still had freedom of speach, even here in Madison County
After reading her bio on google it becomes apparent she loves to hear herself talk or blog.
People like Ms Prata are the reason regular honest people don't want to be involved in politics or government service.
People like her can always tell you how to do it better, but they never wants to do it themselves.
Their only interest is stirring the pot to sell papers or blog visits all at the cost of tearing the communities apart.
Thank You Ms. Prata I hope your blog, and next paper sells as well as your last one in Maine.
Welcome to our Town hope you like it.:)
Why so bitter? Your statements don't make sense.
It seems that Ms. Prata is not only bringing the issue and her experince to the community but she's getting her hands dirty in the process. If regular honest people don't want to get involved that's their choice. However, they should accept the consequences of choosing to be silent.
Being vocal doesn't mean things need to be vicious and personal. It's OK to agree to disagree.
Remember though, "It Takes A Village".
Thank you, Ms. Fortson! Good judgment. Keep up the good work!
Jeff, writing your opinion doesn't cause trouble. If it did, you'd have to apply that definition to yourself.
