Toccoa man charged with battery
A Toccoa man was charged with battery recently after he allegedly beat up his wife at a home on Hudson River Church Road.
Charles Edward McGuire, 33, 19031 Hwy. 106, Toccoa, was charged with one count of battery FVA.
According to the incident report, officer Alan Stratton went to the Hudson River Church Road home earlier in the day, where he met with McGuire’s wife, who asked him how to have a male subject removed from her residence. She told Stratton that she and her husband had not been getting along and she was just wondering what she could do to have him removed. She was told to contact a lawyer and explained the process for obtaining a TPO.
About an hour later at the county complex, Stratton reported that he saw the woman there getting a TPO. An employee of the district attorney’s office told Stratton that the woman had several bruises on her person. Stratton then asked the woman to remove her jacket and he observed several bruises on her arms and legs.
She also said her lower back was hurting. Stratton asked her what had happened and she began to cry and told him that McGuire had beaten her with a closed fist most of the morning. When Stratton asked why she had not told him about this when he came by, she said “because I don’t want him arrested and he is a good daddy.”
He told her no one deserved to be beaten and had photos taken of her injuries by the DA’s office. Stratton then obtained a warrant and went back to the residence, where he found McGuire, who approached Stratton and turned around with his hands behind his back. He said he was “waiting on them” because he knew he was going to jail for what he had done to his wife.
In another arrest, a man was taken into custody after he fled a Madison County officer on a stolen motorcycle.
Jason Edward Smith, 27, 806 D. Williams Road, Commerce, was charged with fleeing or attempting to elude, reckless driving, motorcycle equipment not used properly, driving without a license, theft by receiving stolen property and investigative hold. According to the incident report, officer Michael Moore spotted Smith and a female passenger on Hwy. 98 without helmets.
He activated his blue lights and they took off down Hwy. 98 into Jackson County, passing vehicles and driving recklessly. Moore told dispatch he was not going to continue the chase, but would continue into Jackson County to see if they had continued on or wrecked. Once across the line, he spotted the couple standing up in a ditch where they had wrecked the motorcycle. They were unharmed. Smith admitted the motorcycle was stolen.

•Deborah Still Burton, 51, 1591 Pine Valley Farm Road, Comer, was charged with possession of a Schedule III, IV or V controlled substance with intent to distribute and prescription drugs must be in their original container after a probation officer came to her home to check on her husband, who is a registered sex offender. The probation officer called dispatch and requested assistance when he heard a baby crying inside the home but could not get anyone to come to the door. Officer Jeffrey Vaughn arrived and also heard a baby crying. After several attempts to get someone to the door, Vaughn turned the knob and the door opened. At that point, a woman came out and said she had been sleeping. The probation officer told them that children could not be staying in the home with a registered sex offender. After reporting the violations to his superior, the probation officer and Vaughn conducted a search of the residence where they found narcotics and pornographic DVDs in the bedroom. At this point, Mrs. Burton said the porn and the narcotics, which she did not have a prescription for, were hers and she was arrested. A DFCS worker told the woman she and her children could not continue to stay at the home.

•Frederick Oneil Brooks, 39, 1793 David’s Home Church Road, Comer, theft by receiving stolen property, fleeing or attempting to elude, reckless driving, criminal damage to property in the second degree and removing or affixing license plate with intent to conceal or misrepresent.
•Dequinnte Shaquille Carter, 18, 5851 Hwy. 106 South, Hull, was charged with theft by shoplifting after a clerk saw him take Pop Tarts out of a box and stuff them in his pockets.
•Odell Waller, 45, 574 Cedar Grove Road, Lexington, was charged with theft by shoplifting after he reportedly left Ingles with a shopping cart full of disposable diapers. He was spotted by the manager, at which point he left the cart on the sidewalk and went across Hwy. 29 behind the Apex store. A state trooper located him and held him until he could be returned to Ingles for identification as the suspect.
