A Colbert woman was arrested recently after she allegedly pushed a woman and her child out of her Ford Explorer, causing injuries to the child.

Donna Linette Davis, 43, 683 Scogin Road, Colbert, was charged with battery, DUI/alcohol, cruelty to children, obstruction and two counts of endangering a child by DUI.

According to the incident report, officer Chad Parr was dispatched to Colbert. Diamond Hill Road Friday evening regarding a small child being pushed from a vehicle.

Parr made contact with a witness who said he witnessed a woman and her child being pushed from a Ford Explorer. Parr then spoke to the mother, who he noted was so intoxicated she could barely stand up. She told him Davis was driving the vehicle and said they had taken the kids to the river to play in the water and on their way back home Davis pushed her and her son out. The boy had a laceration on the back of his neck and blood was running down from it. His mother said she was also three months pregnant. While they were talking, several witnesses said they saw Davis’s vehicle coming back toward them.

The vehicle turned around and headed away from the scene at a high rate of speed toward Hwy. 29, with Parr in pursuit.

The vehicle pulled over at Moriah Church Road, where Davis reportedly got out and “staggered” back towards the patrol car. She was taken into custody. A small child was screaming in the back seat of the Explorer and a male passenger told Parr that Davis came to his house and asked him to accompany her, telling him that she had had to kick her friend and her child out of her car and that they were going back to pick them up. He said when she saw the patrol car she turned around and fled, refusing to let him out. The passenger also told Parr that Davis said she and her friend had been to the river and they were both pretty “&*#@!*” up.

DFACS was called concerning Davis’s 4-year old child who was placed in a foster home. The other child and his mother were taken by EMS to Athens Regional.

In another arrest, a fight between brothers over a blanket ended with the older brother being charged with battery last week.

Brandon James Gardner, 21, 53 Sandy Springs Road, Athens, was charged with one count of battery.

According to the incident report, officer Timothy Chad Parr went to the residence regarding a fight between brothers. Gardner told Parr he was cold so he woke his brother up to take one of his blankets from him. His brother began cursing at him, he said, so he drew his fist back as if he were going to hit him. His brother allegedly grabbed a maul that was laying next to him to protect himself, but Gardner punched him in the left cheek and in the nose. Parr noted that the brother’s nose was bleeding and his cheek had a scratch on it. Gardner was taken to jail.

•Austin Kyle Bogue, 20, 1577 Hwy. 172, Colbert, possession of a schedule IV controlled substance.

•Angela Delores Branch, 47, 2275 Waggoner’s Grove Church Road, Colbert, probation violation.

•William Merritt Bryson, 46, 483 Childers Road, Colbert, theft by taking and unsecured load.

•Floyd Earnest Carlson, 55, 321 Gillispie Drive, Hull, hold for North Carolina.

•Aliciabeth Marie Everett, 40, 284 Crawford W. Long Street, Danielsville, hold for Monroe PD.
•Josh Randall Faulkner, 38, 2459 Stone Drive, Comer, three counts of probation violation.

•Crystal Merie Garner, 19, 125 Morrison Lane, Colbert, two counts of cruelty to animals.

•Mark Ellen Garner, 18, 40 East Piedmont Park, Hull, affray (fighting).

•Henry Grady Lord, III, 36, 188 East Ridgeway Park, Commerce, failure to appear.

•Jose Salgado Maldonado, 29, 1088 McLendon Morris Road, Hull, driving without a valid license and following too closely.

•James Blake Norton, 32, 250 Oak Drive, Hull, parole violation.

•Ryan Wesley Porterfield, 45, 119 Archer Road, Colbert, order to incarcerate.

•Charles Russell Scarborough, 22, 5195 Airline Goldmine Road, Canon, DUI/alcohol, weaving over roadway and failure to report striking fixed object.

•Edward Pope Scott, 42, 1105 Spring Valley Road, Athens, DUI/alcohol, weaving over the roadway and driving while license suspended or revoked.

•Hugh Daniel Simms, 38, 2437 Hartwell Hwy., Elberton, probation violation.

•Russell Korey Smith, 28, 9359 Wildcat Bridge Road, Danielsville, DUI/alcohol, weaving over the roadway and no tag.

•Vincent Lamar Walker, 18, 156 Colchester Circle, Colbert, affray (fighting).

I can not understand why both women weren't charged with child endangerment! Both were intoxicated or under influence of drugs. What about the pregnant female?? I guess the unborn child has no rights especially since the child that was thrown from the vehicle is still in custody of his of " intoxicated mother that could barely stand up"!! Madison county police should have arrested both women !! A parent should be held liable for putting their child is such a dangerous situation! Oh but wait, socially if this had been a parent from Kingston Greens she would have went straight to jail! Diamond Hill community parents aren't held to the same standard?? It is our rights as adults to protect these children even if that means protecting them from their own parents! DFCS and Madison county PD do your JOB!!!!!!

I dont understand why pregnant mother of tot thrown from car was not arrested too,wasnt she endangering the life of both her children? When does DFCS and Sherriff's office step in and say enough already.

Concern Madison- I agree with you 110% both women should have been charged. The pregnant Mother should have had 2 charges of child endangerment? 1 for the living child THAT SHE put in the car with a drunk driver, and another one for the unborn child she was carrying? BUT I'm sad to say that the courts in America say that unborn children have no rights because they ain't real people UNTIL they are born?
And another sad fact is if you want to buy a handgun you have to fill out an application and there is a waiting period. BUT anyone can become a parent?

Did you read the entire article since you are so concerned; The mother (which also includes the unborn child) and the child with the laceration were both transported to the hospital by EMS. Would you have rather the officer arrested her then, took her to jail, and the taxpayers could pay her medical bills. I say this deputy did exactly HIS JOB. Thanks officer for being competent!!!

I read the entire Article . and your comment, [and your comment showed your I,Q ] this is not about taxes payers, it is about justice, the laws should be the same for everyone!!! The driver and the intoxicated woman,The intoxicated woman put the child endanger when she put the child in the car,no car seat, not in a seat belt, and she was intoxicated, no charges,where filed on her. My comment, someone is not tell the truth , if I had my child in my arms , you are no one ,could throw me out of a moving car,

LOL!!! It is about tax payers money, and maybe u didnt understand my comment (because dear, your comment showed your IQ). I am sure the woman was charged after she was checked out and left the hospital-its better to have that taken care of BEFORE bringing them to jail. I would much rather have the officers pick them up after being treated than MY tax money paying for them. obviously you dont pay taxes and after trying to read your comment-maybe you collect a monthly check, etc...

URADA- Of course I read the entire article. How would I comment on it if I hadn't read it? Duh. As a matter of fact I would rather them take the pregnant woman to the hospital to be checked out and when the hospital released her THEN arrest her? That is not unheard of? If you are driving drunk and you have a wreck and you complain of injuries they take you to a hospital to be checked out AND when the hospital releases you THEN you are arrested for DUI.

Sorry if you misunderstood my comment, you kind of cleared it up for me; I would much rather them pick her up post treatment so tax payers wouldnt have to pay her medical bills too. She should be arrested and charged, she is not innocent according to the article.

I agree 100% on that. What I don't understand is how she pushed both of them.. The child should have at least been in a seat belt. Don't know anything about the Kingston Green case. But apparently that is were you are from or had some type of dealing similar to this.

The intoxicated pregant woman and her small child that was thrown from moving car, shouldnt she have been arested also she was endangering unborn child and small child. where is the DFCS and the LAW when something like this is going on. as far as im concerned these two children have no chance

I'm sure DFCS was called, but at the HOSPITAL where the mother, child, and unborn child were being treated!! That does not have to go in the paper, and i'm waiting to see if the woman is picked up on charges later (after she is discharged from the hospital)!!!

Anonymous- I'm sure they were called too BUT depending on who the woman is AND IF DFCS has had any reports on her in the past to how much of an investigation will be done? If no reports have been filed DFCS may go out and talk to them and make sure the home is clean and their is food in the home and that the child is not in danger?
